Terms of Service

Welcome to Ship Pup, a shipping services platform. These Terms of Use (the "Terms") outline the terms and conditions governing your use (hereinafter "You" or "Customer") of any services ordered ("Services" or "Booking") from Ship Pup ("we", "us", "our") and its parent, subsidiary, or affiliates, located at Ship Pup (the "Website" or "Site").

By using our Services, you agree that you are at least 16 (sixteen) years old, legally able to abide to the Terms, and you will use our Website to make legitimate purchases of shipping services in the scope of shipping legal products.

If you do not agree with any part of these Terms, please refrain from using our Services.

Service Description

Ship Pup facilitates the connection between the Customer and shipping carriers such as UPS® and FedEx®. We provide a platform to assist the Customer in comparing, selecting, and ultimately purchasing third-party carriers services to ship boxes, luggage, sports equipment (collectively referred as "Package", "Parcel(s)" or "Shipment(s)"). Among others, we supply labels, tracking, ability to review shipping history as described on the Website but we do not provide the actual carriers services. We do not ship, transport, deliver, or otherwise physically handle any shipment.

You acknowledge that you ship your Package at your own risk. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any information or services on the Website and/or on our third-party sites.

You agree that the Services are subject to terms imposed by any third-party shipping companies used by us to transport and handle shipments. You are obligated to ensure that your shipment is in accordance to the terms and conditions imposed by any carrier you select to perform shipping services. If the Shipment does not comply with the terms, is undeliverable or unfit for shipment, fragile or containing prohibited items, we can modify, suspend, or cancel the Service without further notice and with no legal consequences to Ship Pup.

Rates, Adjustments, Payments

Our pricing and rates are determined based on the information you provided, type of services selected, and other factors. One of those factors is the parcel(s) billable weight which is the greater of the actual weight (rounded to the nearest pound) and the dimensional weight in inches (Height * Width * Length / 139).

In certain cases, adjustments to pricing may be necessary due to certain characteristics such as the actual weight and dimensions of each package verified by the shipping carrier at the time of shipping versus the information introduced at the time of booking. If the actual billable weight of the parcel(s) exceeds the maximum allowed for the selected item category, additional charges may be incurred. Delay or loss of shipment, further supplemental fees such as handling large package fees, address correction charges, residential fees, any pickup or delivery location charges may occur as a result of incomplete and/or incorrect information, such as the address, provided at the time of Booking. You are solely responsible for the accuracy and completeness of the information you entered.

Ship Pup is not informed of any extra fees or adjustments until we receive a final invoice from our third-party shipping company. This is a process that may take weeks after the date of the shipment. Consequently, we will email you with the remaining balance incurred due to inaccurate or incomplete information. You agree that we have the right to charge this remaining balance on your credit card or bank account without any further authorization from you. Additionally, in such instances, we will waive the right to any warranties such as loss, delay, or damage protection. If we cannot charge the original credit card, Ship Pup reserves the right to charge any other form of payment method we have on file or you will be notified to settle the remaining balance. A supplemental late fee might be charged if the payment is delayed for more than 30 days.

In case of disputes, you can contact us within 7 days of the re-adjustment email date, and we will make reasonable efforts to investigate. However, since these additional fees are generated by the shipping company, the final determination is done solely by the shipping carrier and not by Ship Pup. We simply pass these extra charges to the Customer.

Ship Pup is not required to automatically provide any refunds or reduction of charges for any inaccurate information regarding the billable weight, number or type of Service used.

Cancellations

In most cases you can ask for your shipment to be canceled. We will refund you the full amount minus a processing fee. The amount of the processing fee may vary depending on the day of the cancellation, if it was requested on or before the shipping date and or if the shipping date has passed. We impose this fee for the use of the site and to cover other fees incurred by our partners.

If the shipment has already been shipped and sent over to the courier, such shipment may not be canceled, and the Customer shall be billed for the full shipment fee. In case a shipment which was previously refunded to the Customer by us, is shipped by the Customer, we will bill and charge you for the related fees.

In case you need to modify your booking, you will have to contact our customer service. In most cases we will be able to assist you, but this will depend on the timing and type of information that needs to be changed.

Preparing and Packing

Preparing and packing your parcel(s) should be in accordance with the selected carrier shipping guidelines. You are responsible for properly preparing, packing, and securing your parcel(s). Ship Pup is not liable for any damage or loss of the shipment or/and its contents. This includes damages to the exterior of the package such as ripped handles, pockets, straps, protruding items, as well as damages to the items included in the packages. Furthermore, Ship Pupdeclines liability for damages resulting from poor packaging, failure to secure or lock your package, failure to require signature upon delivery or to purchase insurance at the time of Booking.

Value Protection and Insurance

Declared Value

Certain carriers offer a declared value program providing declared value limits for loss or damage, subject to terms and conditions (including monetary limits). We will declare value for your eligible parcel(s) through the shipping carrier. You expressly acknowledge that the value of each parcel does not exceed the amount declared. If you do not declare a value for your parcel(s), you decline participation in the value protection and insurance program.

Declare the parcel value based on the replacement cost. You are unlikely to get more insurance compensation for the item than its current retail value, so do not try to insure items over their regular retail cost and pay additional fees.

Insurance Program

We may offer you the opportunity to add parcel insurance coverage carried by one or more third-party insurance programs. The insurance covers physical loss or damage to parcels for which we arrange shipping, but only if the insurance is available and is elected by the Customer, and then only up to the amount of declared value. Your election to add shipping insurance is entirely optional. If you elect to add insurance, any claims against or disputes with any person or entity arising out of or relating to that election must be pursued in arbitration, not in any court proceeding, and must be pursued on an individual basis only, not in any form of class or representative action, whether in arbitration or in court.

We decline liability and insurance will be waived, for specified items, including, but not limited to, the following items:

  • Prohibited items
  • If you provided inaccurate, dishonest or misleading information to us or our partners.
  • If your items are damaged before transit.
  • If your parcel is lost because an incorrect address was entered for the intended recipient.
  • For claims where laptops, LCDs, TVs or jewelry have not been sent through a delivery service requiring a signature and including a tracking number.
  • If there is insufficient evidence that your parcel has been lost or damaged during transit.
  • For claims resulting from theft after documented delivery to the delivery address where no police report related to the theft has been provided.
  • Any claims arising from:
  • Any inherent vice of the product, including but not limited to: mold and mildew; infestation; rust, corrosion, oxidation or other deterioration; or any discoloration.
  • Any hidden or latent defect or any other quality of the items that cause it to destroy itself or cause other property damage.
  • Marring, chipping, denting or scratching.
  • Leakage, loss in weight or volume or normal tear and wear
  • Electrical, electronic and/or mechanical derangement.
  • Data, information technology or electronic risks, including without limitation cyber attacks.
  • Insufficiency or unsuitability of packing of the items.
  • Illegality, willful misconduct, fraud, infidelity, conversion or dishonest acts by you.
  • Delivery delay.
  • Any radioactive, toxic, explosive or otherwise hazardous contamination regardless of the cause. Any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter.
  • For any chemical, biological, bio-chemical or electromagnetic weapon.
  • Claims

    You acknowledge that in no event are we required or obligated to investigate any claims pertaining to lost, damaged, delayed, or missed Parcels. We can assist with submitting information to our third-party shipping carriers if we receive a request from you with proper information and in a timely matter. Your request for assistance does not entitle you to any kind of compensation, legal repercussions or recourse and we are under no obligation to remediate the situation which is exclusively your responsibility.

    You expressly agree that Ship Pup has no liability if any claim is denied or paid only in part by the carrier or other declared value provider.

    All claims must be filed within the shipping carrier required time frame and Ship Pup required time frame. We require the claims to be filed within 10 days from the delivery date and all documentation must be submitted within 5 days from the claim date. Failure to meet the prescribed time frame will result in claims being waived and will not be paid. For all damage claims, the original packaging materials must be made available for the carrier's inspection prior to reshipment. All claims for loss or damage must be supported by the shipping documents and pictures, and proof of the value of the lost or damaged items for any declaration of value.

    Prohibited Items

    Certain items have regulatory, hazard, safety or other considerations and require approval from Regulatory Compliance, Risk Management and Legal departments prior to handling. Transactions involving these commodities are restricted, regardless of origin or destination. It is the Customer's responsibility to comply with any federal, state, provincial, or local government regulations or laws regarding the shipment and transportation of goods in the origin or destination country. You acknowledge that Ship Pup, its logistic shipping partners, and applicable laws forbid shipment of prohibited items and parcels containing such items will void any warranties provided at the time of Booking.

    Examples of prohibited items include, but not limited to the following:

  • One-of-a-kind/irreplaceable articles such as fine artwork, jewelry, gems, furs, watches, etc
  • Precious metals such as gold, silver and platinum in the form of bullion, coins or ingots
  • Fragile items including but not limited to glass, ceramic, porcelain
  • Flammables or hazardous materials, any kind of explosives, combustive materials, fireworks, dry ice, radioactive materials, infectious substances.
  • Firearms, weapons accessories, and ammunition
  • Drugs, including all illegal narcotics, as well as prescription, vitamins, supplements, and over the counter medications
  • Livestock, bloodstock and living animals, pets and insects
  • Alcoholic beverages, or anything containing alcohol including, but not limited to, perfume, cologne, nail polish
  • Any kind of electronics such as laptops, computers, tablets, cell phones, televisions, audio devices, appliances, etc
  • Lithium ion and lithium metal batteries including batteries integrated within electronic devices such as cell phones, tablets, laptops, electronic devices
  • Time-sensitive or critical written materials or documents including, but not limited to, bids and contract proposals
  • Pressurized containers including but not limited to aerosol and CO2 cans and cartridges, bug and bear spray, etc.
  • Auto parts with fluids in them
  • Human or animal remains, fetal remains, human or animal body parts, embryos or components thereof
  • Marijuana, including marijuana intended for medical use and Cannabidoil ("CBD") derived from Marijuana
  • Stamps (postage or revenue); vouchers; tokens; tickets of any kind; and credit, debit or cash cards
  • Lottery tickets or gambling devices
  • Any Liquids
  • Perishable good
  • Medical devices such as but not limited to needles, syringes, etc
  • Cash, bank notes, coins, currency notes or currency or money of any kind or description
  • Tobacco products

    You agree that Ship Pup can deny service, cancel, or otherwise hold shipment in the event that the items in the shipment violate any federal, state, provincial, local laws or regulations.

    Limitations of Liability

    Ship Pup and its partners are not liable for any loss or damage arising from the use of, or inability to use, the Website and the Services. In addition, we are not liable for:

  • Damages or delays caused by various factors, including but not limited to weather conditions, customs procedures, and transportation disruptions.
  • Delays or damages attributable to the third parties that provide the shipping and transportation services or third parties that receive/prepare/provide shipments at origin or/and destination.
  • Damages or losses caused by prohibited items
  • Damages or losses resulting from improper packaging, labeling or inadequate documentation of shipments by the sender.
  • In no event shall Ship Pup and its Parties be liable for any direct damages or losses related to the use of this Website or any Services obtained through Ship Pup in excess of the lesser of the actual damaged item or $100.

    You represent and warrant that shipment of the item(s) in Your parcel(s) is in full compliance with United States and foreign import/export laws and regulations. You agree to indemnify and hold harmless us, Ship Pup, and the carrier from and against all claims, liabilities, judgments, or costs arising out of or related to any acts or omissions by you that are in violation of any United States or foreign import/export law or regulation.

    Warranties

    The Website and Services are offered on "as is" basis. Ship Pup does not offer any warranties regarding the adequacy, accuracy or completeness of the Website of Services offered directly or indirectly by us or by our third-party partners such as the shipping carrier. We disclaim all warranties regarding the information of the Website and Services provided to the Customer by Ship Pup, its parent company, affiliates, and subsidiaries, with all its respective directors, managers, associates, employees, members, contractors, successors, along with third-party partners and affiliates, including but not limited to shipping carriers, service providers, consultants, contractors (collectively known as "Parties").

    All our shipping services are provided by third-party carriers which have no other affiliation to Ship Pup. We do not assume responsibility for any errors, omissions, warranties, negligence, or breaches of any kind resulting from the use of such shipping companies.

    Governing Law

    These Terms shall be governed by and construed in accordance with the laws of Arizona, USA. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Arizona, USA. We do not make any claims that the Website or its content is legal or available for use in other locations. By accessing or using the Website and our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
